Regulation 19(5): Why “Without Delay” Is One of the Most Significant Phrases in Social Care

Regulation 19 is often associated with recruitment. Identity checks. DBS. References. Employment history.


However, Regulation 19(5) is different—and frequently misunderstood.


It applies to existing staff, not new starters. And it is one of the most common areas underpinning CQC enforcement action against Registered Managers.


What Regulation 19(5) Requires


CQC guidance makes it clear that providers must:


  • Regularly review staff fitness

  • Respond without delay to concerns

  • Take immediate action where there is risk

  • Follow fair and correct procedures

  • Put interim measures in place to protect people

  • Inform relevant bodies when necessary


This is not optional. It is a statutory requirement.


The Risk of Delay


Delays often occur because:


  • Leaders lack confidence

  • Managers are unsure whether an issue is “serious enough”

  • There is confusion between support, performance, and misconduct

  • There is no out-of-hours access to advice

  • Concerns are left until supervision


From a regulatory perspective, delay equals risk.


CQC does not expect perfection, but it does expect timely, proportionate action supported by clear systems.


Delegation Does Not Remove Accountability


Registered Managers remain accountable at all times. Delegation is essential, but only if:


  • Leaders are trained

  • Authority is clear

  • Processes are documented

  • Oversight is active


If poor practice occurs at 2am, inspectors will not ask who was on duty. They will ask what systems were in place.
